PROFICIENT HOMES LEGAL
User Agreement
This agreement applies when an owner, homeowner, resident, manager, administrator, vendor, or other invited user creates or activates a Proficient Homes account.

1. Agreement to platform rules
By checking the acceptance box and creating or activating an account, you enter into this User Agreement with Proficient Property Services and agree to the Terms of Use and Terms and Conditions. You acknowledge that you have reviewed the Privacy Policy and Return and Refund Policy.
2. Your role and authority
You represent that the role assigned to or selected by you is accurate and that you are authorized to perform actions taken through that role. Owners and managers are responsible for ensuring they have authority to add properties, invite residents or vendors, issue instructions, upload records, initiate charges, and make decisions. Vendors are responsible for their own licensing, insurance, qualifications, estimates, work, employees, taxes, and legal compliance. Residents are responsible for accurate requests, communications, and payment authorizations made through their account.
3. Shared property information
Proficient Homes is collaborative. Depending on role and workflow, information you submit may be visible to or shared with owners, managers, residents, administrators, vendors, or other authorized participants associated with the property. Do not upload information that is unnecessary for the property workflow or that you are not authorized to share.
4. Documents, notices, and electronic actions
You agree that account actions, messages, acknowledgments, selections, uploads, and electronic signatures may be recorded with timestamps and other audit information. A platform record does not by itself guarantee that a legal notice, lease action, signature, or service of process satisfies every jurisdiction's requirements. The responsible party must confirm the legal method required for the specific transaction.
5. Payments
When you authorize a payment, subscription, charge, or connected payment account, you represent that you are authorized to use the selected method and authorize the transaction described on the payment screen. Software subscription refunds are governed by the Return and Refund Policy. Property-related payments remain governed by the underlying agreement and applicable law.
6. Maintenance and vendor workflows
Maintenance requests, triage, estimates, scheduling, recommendations, completion records, photos, and service messages are workflow tools. Approval in the platform may create obligations under a separate estimate, work order, management agreement, or vendor agreement. Users must review scope, price, authorization limits, safety needs, and vendor terms before approving work.
7. Account security and audit
You agree to maintain a secure password, protect your account, promptly report suspected compromise, and not share access with unauthorized persons. We may maintain security and audit records of invitations, logins, role changes, account actions, document events, payments, and other material activity.
8. No professional advice or emergency service
Proficient Homes does not provide legal, tax, accounting, insurance, engineering, inspection, medical, emergency, or licensed-contractor advice through the software itself. For emergencies or immediate threats to life, safety, or property, contact the appropriate emergency, utility, or qualified professional service directly.
9. Term and termination
This agreement begins when you accept it and continues while you access or use the platform. You may stop using the service, subject to any separate contractual obligations. We may terminate or suspend access as described in the Terms of Use. Provisions concerning records, payments, intellectual property, privacy, liability, and obligations that by their nature should survive will continue as applicable.
10. Electronic acceptance
Checking the agreement box and submitting account creation is your electronic acceptance of this User Agreement and the incorporated policies. You should save or print a copy for your records.
These policies are business terms for Proficient Homes and may be updated as the platform, services, or applicable law change.
