PROFICIENT HOMES LEGAL
Terms of Use
These rules govern access to and acceptable use of the Proficient Homes website, portals, accounts, and platform features.
Effective: September 4, 2026 Last updated: September 4, 2026
1. Acceptance
By accessing or using Proficient Homes, you agree to these Terms of Use. If you create an account or accept an invitation, you also agree to the User Agreement and acknowledge the Privacy Policy, Terms and Conditions, and Return and Refund Policy.
2. Accounts and role-based access
- Provide accurate information and keep it reasonably current.
- Use only your own credentials and keep them confidential.
- Access only properties, documents, messages, payments, maintenance records, and other information you are authorized to access.
- Do not misrepresent your role, ownership interest, residency, management authority, vendor relationship, or authority to act for another person.
3. Acceptable use
You may use the platform only for lawful property, home-care, maintenance, communication, document, payment, vendor, and administrative purposes supported by your authorized role.
- Do not upload unlawful, fraudulent, defamatory, infringing, malicious, or intentionally misleading content.
- Do not attempt to bypass access controls, probe security, scrape protected data, interfere with service, introduce malware, or obtain another user's credentials.
- Do not use the platform to harass, discriminate unlawfully, retaliate, threaten, or violate housing, consumer-protection, privacy, employment, or other applicable laws.
- Do not copy, resell, reverse engineer, or commercially exploit platform software or proprietary content except as expressly allowed by law or written permission.
4. User content and permissions
You retain ownership of content you lawfully submit. You grant us a limited, non-exclusive right to host, process, reproduce, transmit, display, and otherwise use that content as reasonably necessary to operate, secure, support, and improve the service and to fulfill authorized workflows. You represent that you have the right to submit the content and to share it with the users or vendors selected through the platform.
5. Property, legal, and safety decisions
Templates, reminders, maintenance recommendations, notices, summaries, automation, and workflow status are operational aids. Users remain responsible for reviewing lease terms, legal requirements, property conditions, deadlines, vendor qualifications, repair scope, and professional advice relevant to a specific decision. Do not use Proficient Homes as an emergency reporting channel when immediate police, fire, medical, utility, or life-safety response is required.
6. Intellectual property
The Proficient Homes name, software, interface, workflow design, documentation, and original platform content are owned by or licensed to PPS and are protected by applicable intellectual-property laws. These Terms of Use give you a limited, revocable, non-transferable right to use the service for its intended purpose.
7. Suspension and termination
We may restrict or suspend access when reasonably necessary for security, suspected fraud, legal compliance, nonpayment of platform fees, misuse, or material violation of these terms. Property and transaction records may remain retained when required for legal, contractual, security, audit, or recordkeeping purposes.
8. Changes
We may update these Terms of Use as the service changes. Continued use after an effective update constitutes acceptance where permitted by law; when affirmative consent is legally or contractually required, we will request it.
These policies are business terms for Proficient Homes and may be updated as the platform, services, or applicable law change.
